Procedures to change visa for working in a company (NON-B)
Thailand country has many things that attract foreigners to stay in Thailand, whether the cost of living is relatively low, a lot of food, various weather conditions, beautiful natural resources, etc. Most of foreigners usually enter Thailand with a tourist visa before changing the visa to a work visa or another type of visa later. In order to change the type of visa, it can be done but foreigners must hold a Tourist Visa or Transit Visa and the visa must not expire so, the foreigners can request to change the type of visa. In applying for a work permit in Thailand, foreigners must apply for a visa or change their visa to a non-immigrant visa first. Non-Immigrant Visa B or Non-B. In applying for a Non-B, the steps are as follows.
- Apply for a Non-B visa at the Thai embassy or consulate in the foreigner’s country or apply for a change of visa to a Non-B non-immigrant at the Immigration Office in case the foreigner travels to Thailand by holding a tourist visa or transit visa, P.30, PP.30 and PP. 90.
- After receiving a visa as a Non-B, you must proceed to apply for a work permit with the Department of Employment, Ministry of labor, in which the officer will grant a work permit for how long will consider granting permission according to the necessity of the work or as requested and depending on the performance of that workplace, for a period of not more than 2 years at a time, which is usually given by staff for a period of 1 year.
- After obtaining a work permit, then proceeding to apply for a Non-B non-immigrant visa extension with the Immigration Office for a period of stay in the Kingdom for a period of 1 year, which must be submitted before the visa expires 90 days in case the foreigner has not yet traveled to Thailand. The employer can apply for a work permit on behalf of the employee. The foreign employee must show up and receive a work permit within 30 days.
- After obtaining a work permit and a 1-year Non-B visa, foreigners are required to report to the local immigration office every 90 days to provide information about their place of residence at the local immigration office. In case of going outside the country before the next appointment, you need to report the information when you return to the Kingdom, after 90 days from the date of the last entry into the Kingdom.
Required documents and fees for changing visa.
- Form TM. 86 for foreigners with Tourist Visa or Transit Visa to change the type of visa or form TM. 87 for foreigners who do not have a visa but are allowed to stay in the Kingdom type P. 30, PP.30 and 90 to obtain a visa.
- Passport copy, such as personal information page, entry stamp, residence permit stamp (if any), departure card (TM.6)
- One photograph size 4×6 cm or size 2 inches.
- Fee 2,000 baht.
- Letter explaining the necessity of hiring foreigners to work and asking for cooperation in obtaining or requesting to change the type of visa (Specify the name of the company, name of the applicant, position, knowledge, and reason for obtaining or applying to change the type of visa to NON-B), Subject: applying to change the type of visa, and Dear Commissioner of the Immigration Office.
- Employment certificate according to the form of the Department of Employment.
- Copy of juristic person registration certificate, certified by the registrar for not more than 6 months.
- Copy of juristic person registration certificate (PK. 0401)
- Copy of value added tax registration certificate (PP.20), apply for changing of value added tax registration (PP. 09), application for value added tax registration (PP.01), capital increase memorandum and list of shareholders (BOJ5), certified by the registrar for not more than 6 months.
- A copy of the latest year’s financial statements that must be screened and certified by the Ministry of Commerce or the Revenue Department.
- Copy of corporate income tax (PND.50), must be screened and certified by the Ministry of Commerce or the Revenue Department with receipt.
- A copy of the alien’s education proof and work pass proof must be translated into English and certified by the foreign embassy in Thailand or abroad and Legal Affairs Division, Department of Consular Affairs, Ministry of Foreign Affairs in Thailand. - A certificate of educational qualifications and work experience (STM.4), by attach a copy of the ID card with the witness’s signature.
- A copy of the withholding tax list of Thai employees (PND.1) for the past 3 months with the list of Thai employees from the first to the last, must be certified by the Revenue Department with receipt.
- Letter asking for cooperation from the Office of the Board of Investment, Industrial Estate Authority of Thailand, or Petroleum Authority of Thailand in case of BOI promotion.
- Show a color picture of the company taken to show the building, company name plate, working conditions where employees are working, desks within companies or buildings or warehouses which shows about 6-7 work characteristics. Foreigners must take a photo with the director and attach a copy of director ID card with signature. (If the director is a foreigner, a copy of the passport and work permit must be attached.)
- If P.N.D. 50 (page 5, line 3) does not have water and electricity bills, show the lease agreement, water bills, electricity bills, and telephone bills (previous 3 months).

- Certification documents from relevant agencies, must be attached with receipts of certification fees and/or copies.
Rules and things to know when applying for a visa.
- Foreigners who would like to apply for a change of visa to a Non-B must apply at least 15 days before the expiration of the visa. After expiration, foreigners will not be able to apply for a visa change to a Non-B.
- The applicant must come and do it by oneself every time.
- Applicants who come in contact must have a notification of residence in accordance with Section 38 with evidence of a notification of residence.
- The applicant must sign and certify every page of the document.
- Copies of documents of the company, or the authorized directors according to the certificate of registration or the managing partner must sign and affix the seal of the company on all pages.
- All documents submitted in order to change the type of visa to the competent official must be only original documents and complete documents must be prepared for speedy verification.
